Seller Agreement

1. Who this agreement is for

This Seller Agreement governs your use of ComCroft as an artist, in addition to the Terms of Service and Privacy Policy. By accepting you confirm you are at least 18 and legally entitled to contract under English law.

2. Your relationship with ComCroft

You are an independent contractor, not an employee or agent of ComCroft. You are solely responsible for your income tax, National Insurance, and any other obligations from your self-employment. ComCroft does not deduct tax on your behalf.

3. Setting up for payment

To receive payments you must complete Stripe’s identity verification and onboarding with accurate information and a valid UK bank account. You must not provide false information. Until onboarding is complete, your profile will not be visible for commissions.

4. Pricing

You set your own commission prices. Buyers pay your price plus a ComCroft service fee of £1.00 plus 7% of your commission. You always receive your full agreed commission — the service fee is added on top for the buyer.

5. Accepting commissions

Accepting a commission creates a binding agreement to deliver the work described. You confirm you have the skills and capacity, the work will be your own original human-made creation, and delivery will not infringe any third party’s rights.

6. Prohibited content

The following are strictly prohibited and will result in immediate account termination, with any pending payouts withheld pending review:

  • NSFW content: Delivering or accepting commissions for sexually explicit, graphic, or otherwise not-safe-for-work material of any kind is not permitted, regardless of whether it was requested by the buyer.
  • AI-generated work: Delivering work that is fully or partially generated by artificial intelligence tools is not permitted. All work delivered through ComCroft must be created by the artist personally.
  • Delivering illegal, defamatory, or third-party infringing content

If a buyer requests prohibited content, you must decline the commission and may report it to support@comcroft.com.

7. Delivering work

Deliver through the ComCroft platform only. Upload the final deliverable file(s) before marking a commission as delivered.

8. Revisions

Honour the agreed number of revisions. Additional revisions may be declined or charged separately by agreement with the buyer.

9. Payouts

You receive your full agreed commission within 5 working days of approval (or auto-approval after 7 days), paid by Stripe to your connected UK bank account. ComCroft is not responsible for delays from Stripe, your bank, or incorrect account details.

10. Taxes

You are solely responsible for income tax, VAT, and other taxes on income received through the platform. ComCroft provides transaction records but not tax advice — consult an accountant or HMRC if needed.

11. Intellectual property

You retain all IP rights until full payment is received. On full payment, you grant the buyer a perpetual, worldwide, non-exclusive licence for the purposes in the brief, unless otherwise agreed in writing. You must not deliver infringing work, and you indemnify ComCroft against any resulting claims.

12. Other prohibited conduct

You must not: accept payment outside ComCroft for work from a ComCroft introduction; create fake reviews or misrepresent yourself; or use the platform for illegal activity.

13. Disputes

If a buyer raises a dispute, ComCroft will contact you for evidence. Respond honestly and promptly. ComCroft’s decision is final and may reduce or eliminate your payout.

14. Account suspension and termination

ComCroft may suspend or terminate your account for breach of this agreement, including but not limited to delivering NSFW or AI-generated content, persistent delivery failures, false onboarding information, or fraud. Already-approved commissions will still be paid out unless the termination relates to those specific commissions.

15. Governing law

This agreement is governed by English law. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
